La legitimidad de la letra de cambio en blanco, análisis de causas receptadas en la unidad judicial civil de la ciudad de Ibarra, durante el periodo 2021

Abstract

In the present study we intend to analyze the legitimacy of the blank bill of exchange, based on the analysis of cases received in the Civil Judicial Unit of the city of Ibarra in the period 2021. Knowing that the bill of exchange being a mercantile document, which is not regulated by the mercantile normative body, it is used daily without any limitation under the protection of the intervening parties. As for the methodology applied, the methodology is qualitative since we are going to work in the bibliographic and documentary modality, since it is linked to commercial law, a study of this type cannot go beyond what is established in the norms, but it must maintain concordance with commercial law, which has been practiced but which is not established in the normative bodies. Then, by the own retrospective the exposed thing is combined with the qualitative procedure. The Interview is used as an application technique, carried out to professionals in the Mercantile and Civil matters, which will help us to define the concepts of the present investigation. As a result, we will determine it in the discussion based on the blank bill of exchange treated from the documentable and bibliographic research carried out jointly also with the interviews to the professionals in the branch of the civil-mercantile Law, and as Conclusion we will have a socio-natural juridical problem which will have to be treated from the executive framework.
