La justicia de paz y su aplicación en la parroquia de Ambuquí, durante el periodo 2020-2021

Abstract

Justice of the Peace is accepted within the Ecuadorian state as an optional system to solve problems; this is governed by a voluntary and free decision of the people and in this way in conjunction with a Justice of the Peace, characterized by being a respected person within his locality. Its main purpose is to reach a satisfactory agreement for both parties that are in conflict, for this reason the Justice of the Peace intends to seek a solution quickly and efficiently, always based on making an equitable, voluntary decision and in this way avoid going to an ordinary justice system. Under these precedents, this research work entitled: "Justice of the Peace and its application in the Parish of Ambuquí during the period "2020-2021", where the general objective of this research was to determine the effectiveness of the alternative method of "Justice and peace" for the solution of the problems in the Parish of Ambuquí. The specific objectives were the following: a) To describe through a legal and doctrinal study the system of "Justice and Peace" to find its corporate name. b) Determine the effectiveness of this method through the study of the cases presented in the parish of Ambuquí. c) Analyze citizen coexistence in terms of the application of Justice of the Peace. After being analyzed the results of this investigative work shows that this type of Justice in effect, is an alternative to solve a community conflict quickly and efficiently; however, there are situations where the parties in question, do not continue with the process and these cases are filed, with these elements exposed and after the analysis of the cases raised in this parish, They empower me to say that the Justice of the Peace complies mostly with the effective application, because through a kind of agreement and after the two parties give in to their interests, it is possible to reach a solution satisfying the needs of each one.
