Análisis jurídico de la vulneración de Derechos Humanos por la comisión de delitos de violencia intrafamiliar en el cantón Cotacachi, comunidad La Calera provincia de Imbabura

Abstract

This investigation was titled “Legal analysis of the violation of human rights for the commission of crimes of intrafamily violence in the Cotacachi canton, La Calera community, Imbabura province”, which focused its attention on the period 2017-2020. Its general objective was to determine the human rights violated by the committing of crimes of intrafamily violence in the Cotacachi canton, La Calera community, which allow finding legal mechanisms that reduce the rate of violence within the family, which is a matter of interest to both the national legal framework, as well as the international one on human rights. This research is important because it studied a theme that, unfortunately, is common in society and, at the same time, is a promoter of a chain of violence in time and space, which will then continue to generate situations of violation of rights Humans Hence, the beneficiaries of this research would be mothers, children and society in general. The research method was the socio-legal and systematic analytical method, which allowed us to analyze the content of various regulations of both international and national law on human rights. In conclusion, the violation of human rights was determined for the committing of crimes of intrafamily violence in the Cotacachi canton, La Calera community, period 2017-2020. Among the human rights directly violated, is human dignity and the right to integrity as people, physical, psychological and sexual integrity. Another of the rights that is linked to personal integrity is the right to physical and emotional health, as well as the right to protection and effective judicial protection.
