La mediación como método alternativo de solución de conflictos en el ámbito laboral (privado) dentro de la ciudad de Ibarra en el año 2017 - 2018

Abstract

This research deals with mediation as a way to resolve private labor disputes submitted to this legal alternative, the aim of which is to reach an agreement between the parties and conclude the problem in a practical and agile way, shortening the time by virtue of the actor and defendant, in addition to optimizing economic resources for the procedural parties immersed in this constitutional route, thereby decongesting, in part, the work that the courts of the canton of Ibarra have. Its transcendental interest is the protection of the rights of the worker in a fast and efficient way. The methodology used in this research project is the legal partner related to Law and society, since mediation is a social normative nexus as well as an alternative one. In this research it is essential to add the normative method since knowledge of the articles of law defines the use of mediation in the private labor field. The instruments used are the records produced by the mediation acts located in the respective legal institutions of the city of Ibarra. Regarding the investigation technique, the interview is presented as the primary source for collecting clear and precise information within the work environment managed by the mediation centers of the Judicial Council.
