Los derechos de los migrantes en situación de movilidad humana en la ciudad de Ibarra: estudio jurídico sobre el cumplimiento del derecho a la salud en el hospital “San Vicente de Paúl” durante el período enero 2019- agosto 2019

Abstract

Ecuadorian legislation protects and guarantees the rights of people in a situation of human mobility through the different legal bodies. Likewise, the executive through the Ministry of Foreign Relations and Human Mobility, the governing body, encourages planning and establishes public policies on Human Mobility issues in order to ensure the full exercise of the right to health for people regardless of their nationality. Therefore, for this research, the following question was formulated: Is the right to health guaranteed to people in a situation of human mobility at the San Vicente de Paúl hospital in the city of Ibarra during the period January 2019- August 2019? Does the San Vicente de Paúl hospital have special mechanisms and procedures to guarantee due care to people with human mobility? In order to respond to the same, the general objective was established to verify compliance with the right to health of migrants in the city of Ibarra, through an analysis of the normative and institutional instruments in relation to the right to health that is applied in the Hospital San Vicente de Paúl in the care of these people, to measure the effectiveness of this right. As specific objectives were established, to carry out a normative and doctrinal analysis in the context of the right to health in Ecuadorian legislation; study international regulations in relation to the protection of the right to health, and finally determine the number of migrant citizens who received health care at the San Vicente de Paúl Hospital and what has been the public policy of the Ecuadorian State to guarantee access to the right to health. Likewise, to answer the question and comply with the objectives, the normative method and the logical-deductive method were used, in turn, the document review technique and the interview were applied.
