Abstract: The “Legal Analysis of Report N ° 84/09 Case 12,525 Nelson Iván Serrano Sáenz v. Ecuador”. It was developed based on the study of the Ecuadorian legal system, documentary review, international treaties, conventions between Ecuador and the United States, and intervention of Private International Law. To determine the reasons why Ecuador allowed the extradition of Nelson Serrano to a foreign state, where the death penalty is admitted, being sentenced to it for the crime of murder in the first degree. In Polk County - Florida - United States, in a trial where the evidence in his favor distorted and Serrano was condemned with the only evidence against him, the fingerprint of the middle right index finger on a parking ticket dated on December 03, 1997. Same day as the murder of George Gonsalves, Frank Dosso, Diane Dosso, George Patisso, at the Erie Manufacturing company. For this study, the qualitative approach was used accompanied by the normative method since the events of this case have been investigated based on the legal regulations applicable at the time of his arrest, extradition, and sentence, as well as current regulations. Nelson Serrano is on death row, waiting a new trial where proves his innocence, and can act legally and fairly. This case is undoubtedly an event that demonstrates the shortcomings of the Ecuadorian legal system by allowing Nelson Serrano to violate principles of due process, constitutional and criminal rights, human rights, as well as jurisdictional guarantees that he possessed as an Ecuadorian person. However, his extradition and trial to a foreign country were allowed. Currently, the Ecuadorian State, with the help of the Inter-American Commission on Human Rights, is providing all the necessary commitment so that justice can be carried out in the Serrano Case.
Description: El “Análisis Jurídico del Informe N° 84/09 Caso 12.525 Nelson Iván Serrano Sáenz vs. Ecuador” se desarrolló en base al estudio del sistema legal ecuatoriano, revisión documental, tratados y convenciones internacionales entre Ecuador y Estados Unidos e intervención del Derecho Internacional Privado, para determinar los motivos por los cuales Ecuador permitió la extradición de Nelson Serrano a un Estado extranjero donde se admite la pena de muerte, siendo condenado a la misma por el delito de asesinato en primer grado, en el condado de Polk - Florida – Estados Unidos, en un juicio donde se desvirtuaron las pruebas a su favor y fue condenado con la única prueba en su contra, la huella dactilar de medio dedo índice derecho en un ticket de parqueo con fecha del 03 de diciembre de 1997, mismo día del asesinato de George Genosalves, Frank Dosso, Diane Dosso, George Patisso, en la empresa Erie Manufacturing. Para este estudio se utilizó el enfoque cualitativo acompañado del método normativista dado que se ha indagado los sucesos de este caso en base a la normativa legal aplicable al momento de su detención, extradición y sentencia, así como también, normativa actual vigente, considerando que Nelson Serrano se encuentra en el corredor de la muerte a la espera un nuevo juicio donde se pueda comprobar su inocencia y actuar de forma legal y justa. Este caso es sin duda, un acontecimiento que demuestra las falencias del sistema legal ecuatoriano al permitir que a Nelson Serrano se le vulneren principios del debido proceso, derechos constitucionales y penales, derechos humanos además garantías jurisdiccionales que como persona ecuatoriana poseía, sin embargo se permitió su extradición y juicio a un país extranjero. No obstante ahora el Estado ecuatoriano con ayuda de la Comisión Interamericana de Derechos Humanos, están brindando todo el compromiso necesario para que se pueda realizar justicia en el Caso Serrano.
