dc.descriptionEsta investigación tiene por objetivo analizar los delitos de odio que son denunciados en la ciudad de Ibarra durante el año 2016, el mismo que sirvió para poder dar respuesta a la pregunta de investigación: ¿Existe impunidad en los delitos de odio denunciados en la ciudad de Ibarra en el año 2016? Para esto, se realizó un estudio apoyado en dos métodos el normativista y el lógico inductivo, que permitieron utilizar las técnicas de la entrevista y la revisión documental. De tal manera, que para las entrevistas se aplicó dos cuestionarios estructurados de siete preguntas cada uno, dirigidos a cinco Agentes Fiscales de la ciudad de Ibarra y a cuatro Jueces de la Corte Provincial de Imbabura. Por otra parte, para la revisión documental se contó con datos estadísticos proporcionados por Fiscalía General del Estado y también con información de la Función Judicial mediante su herramienta tecnológica SATJE que sirvió para consultar causas. Por lo tanto, los resultados logrados mediante la aplicación de estas técnicas indican que existe impunidad en los delitos de odio que fueron denunciados en la ciudad de Ibarra en el año 2016, debido a que de los 7 casos ninguno logró obtener una sentencia. En conclusión, esta impunidad se da porque Fiscalía no continuó con la investigación, debido que no existieron elementos de convicción suficientes para poder imputar a una persona, ya sea porque la misma víctima no continúo con la tramitación de la denuncia, porque los hechos no concuerdan con el tipo penal del delito de odio, o a su vez porque no existen denuncias claras sobre los hechos de la misma.es_ES
dc.description.abstractThe purpose of this research is to analyze the hate crimes that are reported in Ibarra city during 2016, which served to answer the research question: Is there impunity for hate crimes reported in Ibarra city in 2016? Thus a study was carried out based on two methods, the normativist and the inductive logic, which allowed us to use the techniques of interview and the documentary review. In this way, the structured questionnaires of seven questions each were applied to interviews, addressed to five Fiscal Agents of Ibarra city and four Judges of Provincial Court of Imbabura. On the other hand, for the documentary review there was statistical data provided by the State Attorney General's Office and also, with the information of Judicial Function through its technological tool SATJE. Therefore, the results obtained through application of these techniques, indicate that there is impunity in crimes of hatreds that were reported in Ibarra city in 2016, because in seven cases that exist, none had sentence. In conclusion, this impunity occurs because prosecutor's office is not maintained with the investigation, because did not exist no elements of conviction to be able to impute a person, because the same victim did not continue with the processing of the complaint, because the facts do not match the criminal type of hate crime, or in turn because there are no clear allegations about the facts of it.es_ES
