Título : Inaplicación de la doctrina de la protección integral y del principio del interés superior por los jueces de adolescentes infractores del cantón Ibarra en las medidas socioeducativas, en el año 2016 - 2017

Resumen : This investigation shows that adolescents between 12 and 18 years of age are responsible for their legal acts and unlawful acts, as a consequence, for the commission of crimes that are typified in the Criminal Organic Integral Code must be judged by specialized judges, with a procedure of juvenile criminal justice and socio-educational measures are applied to protect and develop adolescent offenders, to guarantee their education, family integration and constructive inclusion to society; in addition, to promote the exercise of the other rights of the people, in accordance with the Constitution, the International Instruments and what the Code of Childhood and Adolescence. So then, we see that socio-educational measures have a specific purpose. However, judicial decisions, as we see in this investigation, depart from these postulates. The judges literally impose the socio-educational measure, applying the principle of proportionality and because of the crime committed. They do not carry out a hermeneutic, doctrinal, legal analysis of what constitutes the doctrine of integral protection and the principle of superior interest that guarantee, especially to adolescent offenders, to achieve their integral development and the full enjoyment of their rights, in a framework of freedom, dignity and equity, a duty that is imposed on all administrative and judicial authorities in order to adjust their decisions and actions for compliance. This research highlights the need to design standards for the application of socio-educational measures in crimes that are judged with privative and non-custodial socio-educational measures. In that regard, we have designed, even if in a referential way, those standards that can be collected by both legislators and judges specialized in juvenile offenders. We believe in the resocialization of the adolescent offender and for this, especially the administrators of justice in this matter, at the time of their judicial decisions to impose a socio-educational measure, they must make an adequate motivation that allows the imposed socio-educational measure to fulfill true objectives of insertion of the adolescent in society
Descripción : Esta investigación pone en evidencia que los adolescentes entre 12 y 18 años de edad responden por sus hechos ilícitos, por consecuencia, por el cometimiento de delitos que están tipificados en el Código Orgánico Integral Penal son juzgados por jueces especializados, con un procedimiento propio de la justicia penal juvenil y se les aplica medidas socioeducativas que tienen como finalidad la protección y el desarrollo de los adolescentes infractores, para garantizar su educación, integración familiar e inclusión constructiva a la sociedad, de conformidad con la Constitución, los Instrumentos Internacionales y lo que en este sentido señala el Código de la Niñez y Adolescencia. Así entonces, vemos que las medidas socioeducativas tienen un fin específico. Sin embargo las decisiones judiciales, como vemos en esta investigación, se apartan de estos postulados. Los jueces literalmente imponen la medida socioeducativa, aplicando el principio de proporcionalidad y en razón del delito cometido. No realizan un análisis de carácter hermenéutico, doctrinario, legal de lo que constituye la doctrina de la protección integral y el principio del interés superior del niño que permiten garantizar, especialmente a los adolescentes infractores lograr su desarrollo integral y el disfrute pleno de sus derechos, en un marco de libertad, dignidad y equidad, deber que se impone a todas las autoridades administrativas y judiciales a fin de que ajusten sus decisiones y acciones para su cumplimiento. Esta investigación pone en evidencia la necesidad de diseñar estándares para la aplicación de medidas socioeducativas en delitos que son juzgados con medidas socioeducativas privativas y no privativas de libertad. En ese propósito, hemos diseñado, así sea de manera referencial, dichos estándares que puede ser recogidos tanto por los legisladores como por los jueces especializados en materia de adolescentes infractores. Creemos en la resocialización del adolescente infractor y para ello, sobre todo los administradores de justicia en esta materia, al tiempo de imponer en sus decisiones judiciales una medida socioeducativa, deben hacer una adecuada motivación que permita que la medida socioeducativa impuesta, cumpla verdaderos objetivos de inserción del adolescente en la sociedad.
