Abstract: The present final title work report deals with the "Study of national and international standards establishing the right to non-discrimination on the basis of people's economic position and the relationship to the concept of aporophobia proposed by Adela Cortina ". The teleology of this work is to generate knowledge about the contribution and relevance of this concept, in order to deepen the right of people in that economic position not to be discriminated against in accordance with national and international law. The research is based on the qualitative approach and was developed through the inductive method, which was supported by the documentary review, which allowed to take into account criteria of several authors with respect to aporophobia, in addition to making use of national and international regulations which has allowed to identify the relevance of such neologism with the discrimination, rejection and hatred that certain people develop against those who are in poverty status because of their economic status, a situation that leads to the violation of the rights of those excluded, stigmatized and removed from the social circle. In this way it has been concluded that aporophobia is a social problem that must be precised and contextualized both at national and international level according to its specific characteristics, because identifying the problem is the first step to overcome this social pathology that does so much harm to the people who are victims of such practice. The second step is the responsibilities of all, both the international community and the state level with police, judicial, legislative, educational, economic and even family institutional policies. Only in this way will the law of these victims of aporophobia cease to be a compendium of ineffective and invalidated rules on a piece of paper and will suffer a metamorphosis of dignification overcoming, living law and justice.
Description: El presente Trabajo Final de Titulación, trata sobre el “Estudio de las normas nacionales e internacionales que establecen el Derecho a la no discriminación por la posición económica de las personas y la relación con el concepto de aporofobia propuesto por Adela Cortina”. La teleología del presente trabajo es generar conocimiento sobre el aporte y pertinencia de dicho concepto, para profundizar el derecho que tienen las personas que se encuentran en dicha posición económica a no ser discriminadas de acuerdo con la normativa nacional e internacional. La investigación está enmarcada en el enfoque cualitativo y fue desarrollada a través del método inductivo, misma que se apoyó en la revisión documental, lo que permitió tomar en cuenta criterios de varios autores respecto de la aporofobia, además se hizo uso de la normativa nacional e internacional la cual ha permitido identificar la pertinencia de dicho neologismo con la praxis de discriminación, rechazo y odio que ciertas personas desarrollan en contra de quienes se encuentran en status de pobreza por su condición económica, situación que lleva a la violación de los derechos de dichas personas excluidas, estigmatizadas y apartadas del círculo social. De esta manera se ha llegado a la conclusión de que la aporofobia es un problema social que debe ser precisado y contextualizado tanto a nivel nacional como internacional atendiendo a sus características específicas, pues la identificación del problema es el primer paso para la superación de esta patología social que tanto daño hace a las personas que son víctima de dicha praxis. El segundo paso es responsabilidad de todos, tanto de la comunidad internacional como a nivel estatal con políticas institucionales policiales, judiciales, legislativa, educativa, económica e incluso familiar. Solo así el Derecho de estas víctimas de la aporofobia dejará de ser un compendio de normas inválidas e ineficaces en una hoja de papel y sufrirá una metamorfosis de superación dignificación, Derecho vivo y sobre todo ¡justicia!
