Abstract: The text of the Contitution from Ecuador aprobed on 2008, it configures the state of rights as a plurinational and justice one, it also gives garanties specially to human dignity. The constitution recognizes the diversity of the diferent groups of people such as indigenous, afrodescendants, “montubios”, half breeds and so forth, it considers the indigenoud justice like a aprobed legal system, and gives to this kind of justice the jurisdictional power to resolve their internal conflicts thought their own rules and precepts, it means thar our country has ethnic legal pluralism. However, the society until now considers that the indigenous justice is not managed properly, that is the reason why in Ecuador there are continuing controversies and diferents points of view of if it is working or not, because it is a system that is not written somewhere and it applies diferent traditions and purification rituals, showers in cold water, hits with natural plants like the nettle, and knoking with so many instruments created for this especific purpose.With that arguments like an introduction, this investigation analyzes the application of the indigenous justice, at the stage of imparting sanctions, with the objective of determinating if there are violations of human rights, for example the right not to be tortured, cruel treatment, inhuman or degrading; this invetigation take into consideration diferent opinions of doctrinaries of law and indigenous autorities, and it also studies of real cases that happened in Ecuador. The present investigation concludes that the human rights are not violated, because the ordinary justice system and the occidental society judge the diferent ways of solving problems in the indigenous villages without an adequate intercultural interpretation.
Description: El Ecuador en 2008 en su nueva Constitución, configura al Estado de Derechos como Plurinacional y de Justicia, garantizando fundamentalmente la dignidad humana. A su vez en lo colectivo, reconoce la existencia de diversidad de pueblos como los indígenas, montubios, afrodescendientes, mestizos, entre otros y considera a la justicia indígena como un sistema jurídico, dándole una potestad jurisdiccional para resolver sus conflictos internos a través de sus normas y preceptos propios, con esto conlleva a que exista en el país un pluralismo jurídico étnico. Sin embargo, la sociedad hasta la actualidad considera que la Justicia Indígena, aún no está administrada adecuadamente lo que ha provocado constantes controversias por ser un sistema no escrito y que se aplica basándose en las tradiciones de cada pueblo como rituales de purificación, baños de agua fría acompañado de ortiga, el fuete entre otros. Con base en lo anterior, la presente investigación analiza, sí en el ejercicio de la aplicación de la justicia indígena, en la etapa de impartir las sanciones, existe una vulneración derechos, como al derecho a la no tortura, ni a penas o tratos crueles, inhumanos o degradantes, al considerar el uso del fuete, el baño con ortiga, la exposición ante el Publio, actos en contra de la dignidad humana, para esto se toma en consideración diferentes opiniones de doctrinarios del derecho, autoridades indígenas y el estudio de casos prácticos dados en el Ecuador. La investigación permite concluir que no se vulneran los derechos humanos, pues desde el sistema de justicia ordinaria y desde la visión occidental de la sociedad, se juzga las formas de solución de conflictos en los pueblos indígenas, sin una adecuada interpretación intercultural.
