Resumen : The anticipated testimony received in the previous investigation; in relation to the veracity of the testimony of the victim (child, girl or adolescent) of the crime of rape; When there are no material vestiges of the occurrence of the crime, it implies the impossibility of finding indications of the commission's commitment. In the first moments after the crime, the justice operators who receive the testimony from the complaint to the hearing, implies the revictimization of the children or adolescents. In this context, the testimony of the victim of this crime has been treated superficially by legislation, jurisprudence and Ecuadorian doctrine. Leaving this tool in contrast to the rights recognized both for the victim and for who is going to be investigated by the Attorney General's Office. Mainly the right to non-revictimization of victims and the right of the suspect or investigated to be part of the cross-examination when the advance testimony is received. Sexual crimes against children and adolescents are generally committed in hiding and far from the eyes of other people. In this sense, the victims of the crime will be responsible for helping to reconstruct the truth of the crime of which they were victims, serving this testimony as a determining test for the conviction of the judge. Hence, the reception of the testimony and its probative value is analyzed by the effects and the repercussions that it has at the moment of being valued by the judges who will take cognizance of the case. Thus, this problem is addressed from the different conflicting edges by the collision of constitutional rights of both the victim and the researched. It is important to give an account of how the Ecuadorian criminal procedure system and jurisprudence have addressed these issues from the jurisprudential development, as well as the legal provisions that are the basis for application by the administrators of justice.
Descripción : El testimonio anticipado receptado en la investigación previa; en relación con la veracidad de lo atestiguado por la víctima (niño, niña o adolescente) del delito de violación; cuando no existen vestigios materiales de la ocurrencia del delito, implica la imposibilidad de encontrar indicios del cometimiento del mismo. En los primeros instantes posteriores al delito, los operadores de justicia que reciben el testimonio desde la denuncia hasta la audiencia, implica la revictimización de las niñas, niños o adolescentes. En este contexto, el testimonio de la víctima de este ilícito, ha sido tratado en forma superficial por la legislación, la jurisprudencia y la doctrina ecuatoriana. Dejando esta herramienta en contraposición de los derechos reconocidos tanto para la víctima como para quien va a ser investigado por la Fiscalía General del Estado. Principalmente el derecho a la no revictimización de las víctimas y el derecho del sospechoso o investigado a formar parte del contrainterrogatorio cuando se recepte el testimonio anticipado. Los delitos sexuales contra las niñas, niños y adolescentes, son generalmente cometidos en la clandestinidad y lejos de la mirada de otras personas. En ese sentido, las victimas del ilícito serán las encargadas de ayudar a reconstruir la verdad del delito del cual fueron víctimas, sirviendo este testimonio como prueba determinante para el convencimiento de la o el juzgador. De ahí, que la recepción del testimonio y su valor probatorio es analizada por los efectos y las repercusiones que tiene al momento de ser valorado por los jueces que van a tomar conocimiento del caso. Así, se aborda esta problemática desde las distintas aristas conflictivas por la colisión de derechos constitucionales tanto de la víctima como del investigado. Es importante dar cuenta de cómo el sistema procesal penal ecuatoriano y la jurisprudencia han abordado estos temas desde el desarrollo jurisprudencial, así como de las disposiciones legales que son la base para la aplicación por parte de los administradores de justicia.
